Apraxia Kids Third Party Fundraising Agreement

 

Apraxia Kids is grateful for your interest in hosting a fundraiser to benefit our work to support families struggling with apraxia. Supporters like you help to fund important programs offered by Apraxia Kids  as well as raise awareness of childhood apraxia of speech in communities across the country. Thank you for your commitment!

The following guidelines are established to ensure that your fundraiser is compliant with our policies and procedures:

Promotion and Logo Usage

  • Apraxia Kids has no fiduciary responsibility for your fundraiser(s) and assumes no liability for its planning or execution, including all promotion, set-up, staffing (including volunteers), or the collection and management of funds/donations.
  • You will be provided with the Apraxia Kids “Be the Voice” OR “Walk for Apraxia” graphic, which you may freely use in the promotion and carrying out of your fundraiser. You are strictly prohibited, however, from using any other trademark, service mark, logo or copyrighted materials from Apraxia Kids for your fundraiser without the express written consent of the organization.
    • Please do not use the standalone organizational logo or any other graphics downloaded from the internet.
    • Please do not alter the logo provided in any way.
  • Apraxia Kids does not endorse products, firms, organizations, individuals, or services. Accordingly, your fundraiser(s) must be promoted and conducted in a manner that avoids any statement or appearance of an endorsement by Apraxia Kids.
  • All promotional materials must clearly state that your fundraiser is raising funds that will benefit Apraxia Kids, and include the percentage or amount that will be donated to the organization.
  • Apraxia Kids cannot solicit sponsors for your fundraiser and does not provide any donor, volunteer, or celebrity contact information, mailing lists, press contacts, press releases, or formal advertising.
  • Apraxia Kids may be able to assist with fundraiser promotion in a limited manner.

Finance and Tax Rules

  • Apraxia Kids must receive all net proceeds from the event within (30) business days of the conclusion of the event.
  • You may not establish a bank or other deposit or transaction account in the name of Apraxia Kids or the Childhood Apraxia of Speech Association of North America.
  • If payments are made to the event organizer, and the event organizer is not an IRS qualified organization, the payments will not be tax-deductible. If the payments are made to Apraxia Kids, donations to Apraxia Kids are typically tax deductible, though you should consult your tax advisor.
  • Apraxia Kids sales tax exemption(s) (on purchases) cannot be extended to any event or fundraising effort.
  • In the case of proceeds from ongoing product sales, seller must notify giving@apraxia-kids.org within 30 days when sales end or when donations cease. At that time, all language about Apraxia Kids must be removed from marketing materials.

Liability and Cancellation

All events must:

  • Comply with all federal, state, and local laws applicable to any event, including fundraising rules and regulations.
  • Determine the extent of and obtain its own liability insurance for the event sufficient to cover any claim that may arise out of the event. The third part event organizer agrees to indemnify and hold Apraxia Kids harmless from and against any and all losses, damages, costs, attorney fees, expenses, and liabilities incurred in connection with, or with the defense of, any claim or action or proceeding arising out of or incurred in connection with the event.
  • Obtain all permits and/or licenses necessary for fundraising in the city in which the event is to occur, the sale or service of liquor, and the hosting of raffles and/or games of chance.
  • Inform invitees and participants that the event is not produced, supervised, or sponsored by Apraxia Kids and that Apraxia Kids is neither responsible nor liable for any acts of omissions related to the event.

In accordance with the policies of  Apraxia Kids, the following types of items and activities are strictly prohibited for any third-party fundraiser event:

  • Auction items containing firearms or events featuring the sale of firearms such as a gun bash, etc.
  • Partnering with a competing organization soliciting funds from the apraxia community.
  • Promoting or selling products that claim to  improve communication without evidence base for improving speech sound production
  • Partnering with Tobacco Companies
  • Partnering from Companies that sell Erotic or Intimate Products

I accept and agree to abide by the terms of these guidelines with respect to my fundraiser to benefit Apraxia Kids. I hereby release and agree to indemnify and defend Apraxia Kids, its officer, directors, employees, and agents, from and against any and all claims, loss, liability, damages, and expenses (including reasonable attorney’s fees and other costs of litigation) imposed against or incurred by Apraxia Kids arising out of or related to any event I host or any violation by me of these Host Guidelines. This agreement is not valid until your signed copy is received and approved by Apraxia Kids.
